German Shepherd described above is sold for the sum of $1000.00
Balance of payment to be made in full at
the time of the transaction ($200.00 deposit was previously made).
A pet PUPPY is defined here to be a German
Shepherd puppy which is in good health at the time of sale, and embodies the characteristics of the German Shepherd breed
. This PUPPY is purebred and is registerable with the American Kennel Club.
This PUPPY should not be
bred and the BUYER agrees this PUPPY is to be spayed or neutered at the appropriate age, and veterinarian confirmation of
this procedure must be supplied to the BREEDER unless the following paragraph applies.
When both Breeder and Buyer
determine the Dog is free of genetic defects, undesirable temperament traits, and has desirable conformation and qualities
to pass on to its progeny, including, but not limited to: hips, elbows, free of allergies, and other genetically transferred
health/temperament defects the dog may be bred. This requires that the Buyer show OFA certification of hip and elbow dysplasia
(after two years of age) and a letter from the dogs vet verifying no known genetic defects.
The BREEDER guarantees
the above described dog to be healthy at the time of the sale.
The BREEDER does not assume any liability for any
injury to said puppy after delivery.
The BUYER agrees to have this puppy examined by a veterinarian within 48
hours of delivery.
If the puppy is found to be other than healthy by the BUYER'S veterinarian, it shall be returned
to the BREEDER immediately, and the purchase price will be refunded. Deadline for this refund is 72 hour after delivery (puppy
must be returned by this time).
All appropriate shots for the PUPPY'S age have been given, and a record of this
vaccination history is supplied.
The BUYER agrees to maintain the puppy's health in good condition, and to provide
yearly examinations, vaccinations, heartworm test, and any other usual procedures necessary to assure good health. This puppy
has never been exposed to aversion or harsh correction training and buyer agrees to not allow this type of training.
The BREEDER has tryed to produce healthy puppies by checking the background of the dam and sire for longetivity and genetic
problems in their backgrounds, and by raising the puppies in the best way possible in regards to diet, exercise, socialization
and veterinary care. Although there is no guarantee one of the puppies will not have genetic problems, we are striving
to avoid such an occurrence by using animals that have proven their health and longetivity. Our policies on replacement/refund
are stated below. The guarantee below to replace, refund, or partially refund, is good for 24 months from the date of purchase.
In the event that a bitch conceives a litter or a male sires a litter, this guarantee becomes null and void. Outback Shepherds
will not be responsible for any expenses incurred nor will Outback pay for any transportation charges for the replacement
puppy.
We will replace the puppy with another puppy or give a full refund if the puppy is found to have severe
hip dysplasia (moderate or extreme) in which the disease is crippling and properly diagnosed within 24 months of the date
of purchase. The X-rays and the OFA letter of diagnosis must be returned to the breeders. If the buyer chooses to keep the
puppy, a certification of sterilization must be given before any replacement or refund will be made by the sellers and one
half of the purchase price will be refunded.
We will replace the puppy with another puppy or give a full refund
if the puppy is found to have severe elbow dysplasia (Ununited Anconeal Process (UAP), Osteochondritis Dissecans (OCD) or
Fragmented Coroniod Process (FCP) in which the disease is crippling and properly diagnosed within 24 months from the date
of purchase. The X-rays and the OFA letter of diagnosis must be returned to the breeders. If the buyer chooses to keep the
puppy, a certification of sterilization must be given before any replacement or refund will be made by the sellers and one
half of the purchase price will be refunded.
There are many factors that can influence growth and development,
such as diet, exercise, weight gain, etc.. The BUYER assumes the responsibility to carry on with the appropriate vaccinations,
exercise and feeding schedule, as supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy slim throughout
it's normal growth period.
The BUYER agrees that neither he/she nor the BUYER'S estate/executors may sell this
PUPPY or transfer ownership of this PUPPY without the BREEDER'S knowledge and written consent.
The BUYER hereby
agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER
will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY.
The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY'S lifetime.
The
BUYER agrees to use the kennel name Outbackshepherds; or OB at the beginning of the AKC Registration name. The BUYER agrees
to register the Dog with a letter beginning with "C"; and the dogs call name shall begin with the same letter.
The Buyer agrees to provide a suitable fenced area for this puppy.
The BREEDER neither makes or implies
any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation,
the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer
with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and does understand all the
conditions of the Sales Agreement and Contract of Sale.
